Acceptable Use Policy

This Acceptable Use Policy for Nova Microsystem’s (“we” or “Nova”)’s products, including Bricks, (the “Products”) (the “Policy”) identifies activities that you and your organization (“you”) are prohibited from engaging in when using the Products, both in their current version or any subsequent release, and also describes other, related terms.

Acceptable Use of Products

When using the Products, you agree to comply with the following terms:

1.     You agree that your use of the Products is governed by this Policy, the applicable End User Agreement, and any Statement(s) of Work you have with Nova, as specified in the End User Agreement. You can obtain a copy of any version of this Policy, or other agreements with Nova, by contacting Nova support at the contact information below.

2.     You agree not to use the Products in violation of any applicable law or in furtherance of any enterprise or effort conducted in violation of any applicable law, including for any criminal purpose.

3.     You agree not to install the Products on a computer system or network you do not own, unless you are authorized to do so by the owner.

4.     You agree not to analyze, decompile, or reverse engineer; or identify or discover any source code, underlying ideas, techniques or algorithms; or cause a third party to do any of these things on your behalf, for any purpose.

5.     You agree not to remove, modify, or tamper with any regulatory or legal notice or link that is incorporated into the service.

6.     You agree to accurately represent your identity when contracting with Nova for services.

7.     You agree that we are not responsible for how you use or manage the product and that you have ultimate responsibility for the security of your own network and systems.

8.     You agree to pay your bill on time and to provide true and accurate information for billing to Nova.

9.     You agree not to abuse any Nova online platform in any manner which will deny access to the platform by others, or otherwise damage Nova or any of its own systems.

As stated in our End User Agreement, if Nova believes that the Products are being used in an improper or unauthorized manner including in violation of this policy, it will take all such action it deems appropriate, including cutting off access to the Products. Violations of this Policy may lead to the termination of your account.

Privacy

Nova respects the privacy of your personal information. Please review our privacy policy for the details of how we collect and use your personal information, as well as what rights you have regarding it.

By interacting with Nova or its products, you recognize that your personal information may be collected and stored in the United States or Canada and you consent to such data collection and storage.

Rights & Enforcement

Nothing in this policy is intended to grant any rights in the Products. Failure to enforce this Policy, or the End User Agreement or other agreements with us, in every instance does not amount to a waiver of Nova’s rights.

Changes

Nova reserves the right to modify this Policy in its sole discretion, provided that changes shall not infringe your applicable End User Agreement or Statement(s) of Work with Nova. Should Nova make any modifications to the Policy, it will post the amended terms at this same URL and will update the “Last Updated Date” at the top of the Policy. It may also, at its option and without obligation, notify you via email, a customer newsletter or such other written communication method implemented.
